Judge George Davis has ordered for a Jury trial on August 19th in court room s101. A Riverside County Sheriff’s Deputy, will face a Jury and explain as to why he and fellow Deputies left drugs in a home with a 14-year old and his mother, only to return days later with a CPS Agent to reclaim the drugs He and Fellow Deputies Left. Deputy Michael Hamilton has already admitted in testimony before a Judge Timothy Freer in Murrieta Court Room s204 that he did in fact leave drugs in the resident’s home, Deputy Michael Hamilton also acknowledged in testimony that he had undergone Drug courses via Department Training!

Records show other Riverside County Sheriffs were involved as well, including a Deputy Brett Pendleton who has recently been arrested for a DUI and is facing Jail Time. Deputy Michael Hamilton did make an arrest of a 14-year old on the day of his search and chose to release the teen without any charges, In which the victims intend to prove was a set-up for a returned search which did occur days later by Deputy Michael Hamilton and another Riverside County Sheriff’s Deputy. (  It should also be noted: Deputy Michael Hamilton’s Police report does not show the arrest of the Teen according to the victims).

On the Day that Deputy Michael Hamilton conducted a search at the victims home records show that Deputy Michael Hamilton was the last Deputy in control and in Possession of the drugs,( See Testimony ) without informing the mother and child they were ordered  back into their home stating that it was safe. ( Note: Other Witnesses who were at the scene will testify ‘ that Deputy Michael Hamilton did not inform members of the community that he and fellow Deputies would be leaving drugs in the home).

Note: arriving family members whom met with Deputy Michael Hamilton at the scene were also never told that Deputy Michael Hamilton and Fellow Deputies would be leaving drugs in the home.

According to the Victims Deputy Michael Hamilton had plenty of opportunities to inform family and members of the community, That he and fellow Deputies would be leaving drugs in the home, But chose not too, instead returned days later with a CPS agent.

Un-Aware that Drugs were left in their home! A few days later Deputy Michael Hamilton returns back to the home with a CPS agent a demands for the drugs, in which he and fellow Deputies left at the residence.

The Victims were outraged at the Deputy’s conduct, citing that the Riverside County Sheriffs put the family and child’s safety at risk for days, including a community as the child has friends spend the night at his home from time to time.

A complaint was filed against Deputy Michael Hamilton which was investigated by a Deputy whom was involved, in which the Victims allege was a form of intimidation.

To date the drugs have mysteriously disappeared, there are no indications, that the drugs were seized and or tagged into evidence nor does the Temecula based Sheriff’s department have any Records of Marijuana being transported or booked into their station.

The District Attorney’s Office Handled by Paul Zellerbach was fully aware of this incident as the DA heard the Testimony in front of A Judge Timothy Freer, including other numerous complaints in and out of the court room. Yet Judge Timothy Freer and the District Attorney’s Office chose to do Absolutely nothing in the matter of Public Safety regarding the Team Of Deputies, Knowing that the Child and Mothers safety were put at risk and in danger by a team of Riverside County Sheriff’s Deputies, nor did they question the Deputy at testimony as to how the drugs got to the scene, The District Attorney’s Office was also fully aware of a Deputy Investigating himself and fellow Deputies after a Complaint was filed . Records show that a Deputy a SGT Vance Stolte who was involved and present the day of the search even made numerous calls to the Victims home and Cell phone months later to include a visit and questioning of the child at an uncle’s home, in which the victims say was another form of intimidation. None of the Victims were Drug tested the day of the search, Fact NO Charges were brought on the Marijuana.

Victims also allege: That Judge Timothy Freer continues to deliberately place himself at court hearings, in order to protect and or favor the Search warrant in which he signed,  which again Involved the actions of Deputy Michael Hamilton, Sgt Vance Stolte and Other Sheriff’s Deputies including outside Civilians ( Wal-Mart Loss prevention Agents ) involved in the search..

Fact Deputy Michael Hamilton Returns Back to the Home Days Later to conduct a Drug Test On the Father Only! ( The District Attorney’s Office Was Aware ) as they have the Deputy’s reports which indicates marijuana numerous times, but the report does not indicate what Deputy Michael Hamilton and Fellow Deputies did with the Marijuana and or where it disappeared too, however it was revealed in Deputy Michael Hamilton’s  Testimony.

The Victim(s) in the Matter intend to subpoena up to 20 individuals which will include, Border Patrol agents, Civilians, Sheriffs Deputies and more whom were all present at the scene the day Deputy Michael Hamilton and his fellow Deputies Left Drugs In a Home, without informing the mother and child before ordering them back in again stating that is was safe.

According to the reports of all those present that day, The Facts will show Deputy Michael Hamilton and other members of the Special Enforcement Team Aka ( Special Enforcement Tactics ) whom were last in control and in possession of the drugs in which they left according to Deputy Michael Hamilton’s testimony.

The Victims STATE their child doesn’t smoke marijuana why he was arrested and let go is bizarre..

( Willing to take any test to prove it ).

when the Father returned back home, unaware that there was Marijuana left in the home, the father did locate in what appeared to be a green leafy substance ( a plain leaf ). in which the Father disposed of it.

( which is different from what Deputy Michael Hamilton described he left in his Testimony ).

This information was relayed to Deputy Michael Hamilton on his second search of the home days later when he returned with a CPS agent.

The father also states that he felt intimidated by Deputy Michael Hamilton and in Fear of His safety, Including his Families Safety including that Deputy Michael Hamilton might Re-Arrest his son again, he felt forced to answer and go along with questioning, that Deputy Michael Hamilton Interrogated the father without the presence of an attorney or his Miranda rights being read prior to being questioned.

To also include a field drug test performed only on the father by Deputy Michael Hamilton in which Deputy Michael Hamilton performed in the Families kitchen, though Deputy Michael Hamilton saw no signs of Drug use, the father still insists that it was another form of intimidation. In fear of his safety including the Families safety or the possibility of his son being re-arrested the Father felt he had to say things that went along with Deputy Michael Hamilton’s interrogation questions fearing that their child would be taken away.. since no Miranda rights were read nor did Deputy Michael Hamilton ask the Father if he wanted an Attorney Present.

It wasn’t until Deputy Michael Hamilton continued to Demand for Marijuana during, Deputy Michael Hamilton’s Interrogation with the father, that the father and family ( Mother and Child who Was in another room listening ) realized that there was more than one amount! That Deputy Michael Hamilton and His fellow Deputies left at their Home! including in the Deputies report which verifies the numerous amounts which were read at a later time. There is more to this story the victims allege, as they intend to bring everything out in court.

Stay Tuned as we continue to update this story..
